Privacy Policy

Robin Voice, Inc. d/b/a Commons (“Commons,” “Company,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect personal information in connection with our website located at https://usecommons.com (the “Site”) and our messaging platform and related services (the “Services”). This Privacy Policy does not modify or replace the Software as a Service Agreement between Commons and its customers.

1. Our Role

Commons operates primarily as a service provider to organizations that use our Services to communicate with their audiences. For customer account information and website visitor information, Commons determines the purposes and means of processing. For messaging data uploaded or transmitted by customers, including phone numbers and message content, Commons acts as a service provider or processor on behalf of its customers.

If you receive a message sent using Commons and have questions about how your contact information was obtained or used, you should contact the organization that sent the message directly.

2. Information We Collect

Information You Provide Directly

We collect personal information that you voluntarily provide when you request information, communicate with us, enter into a customer relationship, sign an agreement, or otherwise interact with the Site. This may include your name, email address, phone number, organization name, billing information, and the contents of communications you send to us.

Customer Account Information

When an organization becomes a customer, we collect information about its representatives and authorized users. This may include name, work email address, work phone number, login credentials, and account activity information. We use this information to provide and administer the Services.

Customer Messaging Data

“Customer Messaging Data” means information processed by Commons on behalf of a customer in connection with messaging, calling, routing, delivery, engagement, inbound response, transcription, classification, recordkeeping, or related Services, including phone numbers, message content, delivery information, engagement data, inbound messages, call data, transcripts, and structured communication records.

Customers use the Services to upload and manage contact information and send messages. In providing the Services, we process, on behalf of customers, phone numbers, message content, delivery and routing information, engagement data (including replies and opt-outs), and inbound messages or call data. Commons processes Customer Messaging Data only to provide, support, secure, and maintain or improve the security, integrity, reliability, and quality of the Services provided to the applicable customer, as permitted by the applicable Software as a Service Agreement and Data Processing Addendum. This includes transmitting messages, handling inbound communications, generating and storing transcripts or structured records of voice communications, and structuring or classifying interactions. Commons does not determine the content of customer messages and does not control how customers collect recipient contact information.

Automatically Collected Information

When you visit the Site, we and our service providers use cookies and similar technologies to collect technical information, such as your IP address, browser type, device information, pages visited, referring URLs, and interaction data. We use this information to operate the Site, remember your preferences, understand how the Site is used, and measure and improve performance, including through Google Analytics. Where required by law, non-essential analytics technologies are used only after consent. You may review or change your choices through Cookie Settings in the Site footer or through your browser settings, although disabling certain cookies may affect Site functionality.

Payment Information

Payments may be processed through third-party providers such as Stripe. Commons does not store full credit card numbers. Payment information is processed by the applicable payment provider in accordance with its privacy policy.

3. How We Use Information

We use personal information to provide and operate the Services; deliver and process messages on behalf of customers; administer customer accounts; respond to inquiries and provide customer support; process billing and payments; analyze customer account and platform activity to understand engagement and provide relevant support, product updates, marketing communications, or other requested information; maintain platform security and integrity; detect fraud or abuse; monitor, analyze, and improve the Site and Services; and comply with legal obligations. Commons does not sell personal information obtained from or on behalf of customers.

Commons may use, license, analyze, or make available data that it lawfully obtains or generates independently of Customer Messaging Data, including public-record, aggregated, or de-identified data, subject to applicable law. This does not authorize Commons to sell Customer Messaging Data or use Customer Messaging Data outside the scope of the applicable customer agreement.

Commons does not use Customer Messaging Data to train general-purpose artificial intelligence models, create cross-customer benchmarking products, create customer-specific intelligence products for other customers, or make Customer Messaging Data available to other customers, except as permitted by the applicable customer agreement, written customer authorization, and applicable law. This does not restrict Commons’ use of information that is collected, obtained, licensed, or generated independently of Customer Messaging Data, or aggregated or de-identified data that is not reasonably capable of identifying a customer, recipient, or individual.

4. How We Share Information

We may disclose personal information to service providers and other vendors that help us operate the Site and Services. These may include telecommunications carriers and messaging gateway providers; cloud infrastructure providers; voice, transcription, and AI processing providers; contracted service partners that assist with managed or peer-to-peer campaign sending; website hosting and analytics providers; and payment providers. Current examples include Bandwidth, Amazon Web Services, ElevenLabs, OpenAI, Framer, Google Analytics, and Stripe. We require service providers acting on our behalf to process personal information only for the contracted services and subject to applicable contractual and legal restrictions.

Message transmission necessarily involves telecommunications carriers and gateway providers, which may process message content as part of delivery.

Certain features of the Services may involve data sets that are not specific to any individual customer and are not Customer Messaging Data. Those data sets may be made available to multiple customers where permitted by applicable law and the applicable customer agreements.

We may also disclose personal information if required by law, subpoena, court order, or governmental request. If Commons is involved in a merger, acquisition, restructuring, or asset sale, personal information may be transferred as part of that transaction.

5. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy. In determining retention periods, we consider the nature and sensitivity of the information, the purposes for which it is processed, applicable customer instructions and contractual requirements, legal and accounting obligations, and the need to resolve disputes or enforce agreements. Customer Messaging Data is retained and deleted in accordance with the applicable customer agreement and Data Processing Addendum, subject to applicable legal preservation requirements.

6. Security

Commons implements reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Messaging Opt-Out

If you receive a message sent using Commons and wish to opt out, you may reply “STOP” or follow the opt-out instructions provided in the message. Commons processes opt-out requests on behalf of its customers. Questions regarding specific messages should be directed to the sending organization.

8. State Privacy Rights

Depending on your state of residence and subject to applicable exceptions, you may have the right to request access to, correction of, deletion of, or a portable copy of your personal information; to opt out of the sale of personal information; and to appeal a decision regarding your request. We will not discriminate against you for exercising an applicable privacy right. Commons does not sell Customer Messaging Data or personal information obtained from or on behalf of customers. Commons does not use personal information for targeted advertising or for profiling in furtherance of decisions that produce legal or similarly significant effects.

To submit a privacy request, contact us at privacy@usecommons.com. We may verify your identity before responding. If we process your information solely on behalf of a customer, we may direct you to contact that organization directly.

9. Children's Privacy

The Site and Services are not directed to children under 13 years of age. Commons does not knowingly collect personal information directly from children under 13.

10. U.S. Operations

Commons operates in the United States and does not intentionally transfer personal information outside of the United States.

11. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version at https://usecommons.com/legal/privacy and revise the “Updated” date above. If a change materially affects how we use personal information, we will provide additional notice or obtain consent where required by law.
